According to The Dallas Morning News, Lozano was indicted for murder in 2002, but the charges were later dropped by the District Attorney, who claimed a medical examiner determined Viki committed suicide.

Paul Johnson, the Denton County District Attorney, took over the case in 2007. According to ABC affiliate WFAA, Bobby Lozano was successfully prosecuted in 2009 and sentenced to 45 years in prison. Bobby Lozano began dating Cindy Waters in February 2001, but after his first wife's death, there is no information on his second wife. Both Bobby and Cindy were married at the time of their relationship.

Cindy joined the Denton Police Department in 1994 and was promoted to detective in 2001. Bobby was expecting his first child, while Waters had two. On Monday, July 8th, Denton PD Detective Cindy Waters informed her superiors that she and Bobby were in a relationship. Bobby and Waters resigned from the Denton Police Department three weeks after Viki's death.

Bobby Lozano explained to Cindy that his relationship with Viki was more of a friendship than a romantic one and that they did not get along. He also revealed that they had planned to divorce a year after Monty's birth in August 2002. As per the News Bobby gave Cindy a promise ring in December 2001 and had talked of marrying her. Bobby informed her rumored second wife Cindy that he and Viki had agreed to divorce and that he would be moving out. Lozano also informed her that he had rented an apartment to live in following the divorce. He told Cindy at one point that divorce papers had been filed, but Viki's mother had paid to have the records sealed. Cindy later discover that those papers were never filed. Meanwhile, she found Bobby had lied to her about a trip he had taken. He pretended to be visiting relatives, but he was actually with Viki, Monty, and his mother-in-law.

Meanwhile, Cindy planned to end their relationship after that, but Bobby asked for a second chance. He told her that if he wasn't moved out, he would understand if she wanted to call it quits on their relationship. Bobby informed Cindy that he couldn't leave because he and Viki had gotten into a fight, he slapped her, and he didn't know whether she would press charges or not. He returned all of the cards Cindy had given him throughout their relationship at that point.

Other than this, Bobby also took out a $350,000 life insurance policy after the death of Viki. This was in addition to the $750,000 policy he had purchased for Viki in 1999.
